By visiting the PCBL website or using any material stored herein, you agree to these Terms of Service. The latest Terms of Service supersedes all prior revisions, and has precedence over any verbal or written communication. PCBL reserves the right to modify its Terms of Service at anytime. If changes to this statement are significant (as determined by PCBL), PCBL will try to notify you by sending you an e-mail at the address associated with your account. GENERAL PCBL reserves the right to discontinue or modify any part of the website (including fees) at any time and without prior notice, It also reserves the right to require that specific software be placed (or configuration made) on your system in order to access specific functions on the site. PCBL offers you products, services and access in good faith that the information you provide us is truthful. Failing to provide truthful information may result in the permanent removal of your account, your ineligibility to use discounts and coupons, and denial of access. ACCESS LIMITS Although PCBL seeks to develop a "one-world library," PCBL will provide no product or service to individuals from countries on which the United States Government has placed a trade embargo. The countries affected are identified by the United States Government, and currently include (but are not limited to) Cuba, Iran, North Korea, Sudan, or Syria. Any software or service you obtain on this site is not to be sent, sold or distributed in any form to any person or entity belonging to any of these countries. Whether you are exporting or importing any software or service from us, you agree that your actions are in compliance with any local and/or foreign government regulations, as applicable. OWNERSHIP This website primarily contains property belonging to PCBL, but may contain material belonging to other parties. Unless otherwise expressed, all material belongs to PCBL. You must obtain written permission from the respective owner(s) to use any material on this site. Such material includes logos, graphics, text, programs, scripts, and any other types of files (or parts thereof) obtained from PCBL. This includes but is not limited to products created by other manufacturers or posts in the message Forum. Forum users are responsible for their individual account and posted messages. PCBL will not assume responsibility for action taken by others. Unless otherwise stated, it is strictly prohibited to share any material from PCBL with other parties. All purchased material is owned by PCBL. All products available from us are LICENSED to users/customers, meaning that PCBL maintains ownership of the software you download and/or purchase, although you may own the medium on which it is stored. Accounts, access codes (user ID and passwords), targeted coupons, targeted discounts, and licenses to use PCBL software are all non-transferable. ALL logins, passwords, and access information is the property of PCBL and cannot be shared with third parties. PCBL will never ask you for your password or login information. PCBL encourages the sharing of materials that are freely available (without purchase) to all from the PCBL site, under the condition that any shared material is distributed in its ORIGINAL and unmodified form, containing the original PCBL logo and/or copyright information, clear attribution to PCBL is provided, and the Access Limitations clause is not violated. Processing fees are non-refundable. In cases where an order cannot be fulfilled due to reasons such as, but not limited to, the purchase of services for invalid or non-existent licenses, restrictions imposed by government sanctions, or other unforeseen circumstances, no reimbursement of processing fees will be provided. ILLEGAL ACTIVITY & SECURITY PCBL seeks to use the latest technology to keep data secure. For maximum security, PCBL reserves the right to monitor users and site usage at its discretion. Unauthorized attempts to access information, products, or services (hacking), or accessing any data via questionable means is strictly prohibited. PCBL takes hacking seriously and WILL notify the Federal Bureau of Investigation (FBI) of such criminal activity. PCBL and its affiliated third parties reserve the right to collect and use any information that helps identify the source of unauthorized access, attempts, or suspicion thereof. Among other things, PCBL and its affiliated third parties may use cookies, identify IP addresses, and store activity logs. PCBL can use any and all information at its disposal to protect itself and/or its partners, affiliates, customers, and subscribers. Illegal and objectionable behavior is strictly prohibited. Such action includes, but is not limited to, providing false information, using false identity, subscribing unaware third parties to the PCBL subscription service, recklessly or intentionally affecting PCBL with any malicious virus, worm, trojan, or any script or program that degrades or limits PCBL's capacity (regardless of the extent) to provide standard service. PCBL reserves the right to indefinitely bar access to users, computers, or networks from which such action originates, and may take legal action for incurred damages. You are strictly prohibited from reverse engineering any and all products or work obtained from PCBL, whether it is done by yourself or another party, whether they are viewed in your browser, downloaded or provided to you via any medium. You also cannot reverse engineer any downloads obtained through typical web browsing (temporary internet files, etc). LOGIN & ACCESS You are responsible for the confidentiality and safekeeping of your user ID and password and all associated activity. In the event you are aware that your login account may be compromised (someone other than yourself may have access to your login information), you agree to immediately change your password and notify PCBL via the “Contact Us” link if you have any problems doing so. You are also responsible for, and expected to, maintain up to date contact information so that in the event of important notifications, PCBL can contact you. PCBL reserves the right to restrict the amount and type of access you have, including (but not limited to) prevention of concurrent logins, limiting bandwidth usage (the speed and/or number of downloads), the number of times you can log in to the system within a certain period of time, or the frequency messages can be posted in the Forum. PCBL also reserves the right to close and permanently remove accounts that are inactive for an extended period of time. PCBL is not liable for damages incurred to you or third parties when exercising its rights. PCB LIBRARIES FORUM Use of the PCB Libraries online message forum located at https://www.PCBLibraries.com/forum should be within the forum rules posted there. Please note that PCBL reserves the right to modify usernames, delete, edit, or move messages that it deems are inappropriate. SUBSCRIPTION PCBL reserves the right to send you email notices about changes to the User Agreement or other important notices whether or not you subscribe to the newsletter or forum. PCBL reserves the right to combine offers from other companies in such email communications. You can subscribe and unsubscribe to PCBL's email notification services by logging onto your account. PCBL can help you unsubscribe, but is not responsible for your decision to do so, nor is it responsible if unsubscribing takes longer than usual due to extenuating circumstances. PCBL is also not responsible for software updates you may have missed if you unsubscribed. Most of the time, changes to your subscription status are posted immediately to the database, but you may not see this change for as long as 48 hours. You may, at your discretion, terminate your PCBL account. Terminating your account means you will no longer have access to certain areas of the website, previous purchases (including product upgrades) and you will no longer receive PCBL email sent in bulk. Terminating your account does not necessarily mean that all of your information is removed from our database (i.e. purchase records, and logs of your site visits and account usage may still exist.) PCB POD PCB Parts-on-Demand (PCB POD) access is an online part database that complements Footprint Expert users, and is available in 100 - 500 part per month subscriptions. Part requests (for any part not currently in our database) will cost extra. Users with the free Footprint Expert POD Builder will need to purchase all content, and may not be able to transfer the neutral FPX files between computers, but will not have this limitation once the parts are translated to their native CAD format. PURCHASES All purchases are final. If any adjustments need to be made to an order based on erroneous order, there will be a 20% processing/restocking fee. WEB LINKS PCBL provides links to other sites (especially in the message Forum), but has no control over the content of the material presented on these sites. PCBL will assume no responsibility for the data, products or services provided by these linked sites, or any damages incurred by your visit to them. LINKING TO PCBL & LOGO USAGE Using the PCBL logo without permission is prohibited. For permission to use the PCBL logo, please contact us via the “Contact Us” link from the main menu. Use of the PCBL logo cannot be used in derogatory contexts. It cannot be used in conjunction with, or in any way associated with, illegal or questionable material, such as pirate software or spam (unsolicited) email. If you or your site promotes or condones such behavior, you are prohibited from using the PCBL logo. PCBL may take legal action to claim compensation for damages related to such action. Whenever possible, the logo should be linked to the PCBL site. Your use of the PCBL logo does not mean that you are in any way partnered with PCBL or that PCBL sponsors or endorses your organization, service, product, or website in any way. You are not authorized to imply or specify otherwise. If you link to any PCBLibraries.com page, the PCBL page must come up in a page without frames. DISTRIBUTORS & OTHER PARTIES PCBL is not obligated to any Distributors or third party to perform any service, provide any product, or take any action, expressed or implied, unless such action reflects a written agreement made between PCBL and the respective party. PCBL Distributors are third-party referrals and are not to be confused with representatives or partners of PCBL. Distributors are limited to referring visitors and potential customers to PCBL and promoting PCBL services and products. Occasionally, leads may be provided to Distributors who have agreed to handle all information with care. Distributors are only entitled to a commission for referrals that have culminated in a PCBL product or service purchase directly from Distributor, via the Distributors' authorized link. It is the Distributors' responsibility to provide their correct and valid link. Distributors work in good faith that when they refer you, you purchase through them or user their Distributor link and no other for any subsequent PCBL purchases you make. ADVERTISEMENTS PCBL may place advertisements on its website, but has no control over the actions of these advertising parties. PCBL will not be responsible for the fulfillment of any promises or guarantees provided by those advertising on the site. You agree that you will not hold PCBL liable, and all disputes linked to advertisements will remain between you and the party or parties who advertised. You agree to immediately notify PCBL of any disputes relating to advertisements posted on PCBL and will not file fictitious complaints. DISCLAIMER Data and materials on this site are provided “as is” with absolutely no warranty, expressed or implied. PCBL will try to ensure this site and products are available, secure, accurate, virus-free, and bug-free. PCBL may forward some basic information you provide to your local distributor, so they can follow up with you to make sure you are aware of all PCBL software features, services, and current promotions. PCBL distributors are not permitted to forward your information elsewhere. All information you provide to PCBL Distributors or other parties (such as advertisers), whether or not you link to them from PCBL, is collected and maintained by the respective parties, not PCBL. PCBL is not responsible for how your information is stored, used, or handled by third parties. It is important that you note when you are dealing with PCBL Distributors that while they may co-brand or display the PCBL logo on their website, their privacy policies are likely to vary from those of PCBL. PCBL will use Distributors and third parties that are reputable and may discontinue business relationships with parties whose actions or services become questionable. Sometimes PCBL may share your personal information with third parties for the purpose of providing you a product or service. For instance, purchases will require that PCBL share all related personal and payment information (including, but not limited to name, address, and credit card numbers) with processing companies. PCBL also forwards registration information of users to PCBL Distributors local to the user for the Distributors to follow up for questions and inquire of interest of purchasing PCBL products. The respective parties, not PCBL, are each responsible for how they handle your information, whether provided by PCBL or directly given by you to such parties. Their use of your information will not be bound by the PCBL Privacy Policy or Terms of Use. PCBL Forum Moderators may have access to any information in your forum profile, including your email address. You should provide no information in your PCBL Forum profile that you do not wish to share. INDEMNITY You agree to defend, indemnify and hold harmless PCBL, its partners and Distributors, from any and against all liabilities, claims, damages and expenses (including reasonable attorney's fees and costs) arising out of your use, or your inability to use, the PCBL site or any content therein. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona. The parties hereby irrevocably consent to the jurisdiction of the state and federal courts located in Phoenix, Arizona, in any action arising out of or relating to this Agreement, and waive any other venue to which either party might be entitled by domicile or otherwise.
